Welcome to Radius!

These terms and conditions outline the rules and regulations for the use of Radius.

By using this app, we assume you accept these terms and conditions. Do not continue to use Radius if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice, and all Agreements: 

• "User", "You" and "Your" refers to you, the person who logs on to this App and is compliant with the Company’s terms and conditions. 
• "The App", "Ourselves", "We", "Our", “Company”, and "Us", refer to our Company: Radius. 
• "Party", "Parties", or "Us", refers to both the User and Radius. 

All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the User in the most appropriate manner for the express purpose of meeting the User’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to, prevailing law of Saudi Arabia. 

Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

1. RADIUS RULES

Before you can use the App, you will need to register for an account (“Account”). In order to create an Account you must:

• be at least 13 years old or the age of majority to legally enter into a contract under the laws of your home country; and
• be legally permitted to use the App by the laws of your home country.

You’ll have great fun on Radius, but if you feel the need to leave, you can delete your Account at any time by going to the ‘Settings’ page when you are logged in and clicking on the ‘Delete account’ link. Your Account will be deleted immediately, and Your Content (defined below) will be completely removed from the App. Your profile information will be treated in accordance with our Privacy Policy. If you delete your Account and try to create a new account within this time period using the same credentials, you will lose all the data saved before.

You may not access, tamper with, or use non-public areas of the App or our systems. Certain portions of the App may not be accessible if you have not registered for an Account.

2. TYPES OF CONTENT

There are 2 types of content that you will be able to access on the App:

• Content that you upload and provide (“Your Content”); and
• Content that members provide (“Member Content”); 

There is certain content we can’t allow on Radius:

We want our users to be able to express themselves as much as possible and post all sorts of things on Radius, but we have to impose restrictions on certain content which:

• contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm, or annoy any other person (including for example and without limitation, language that could be deemed discriminatory towards an individual’s race, color, ethnicity, national origin, religion, disability, or physical appearance);
• is abusive, insulting or threatening, discriminatory or which promotes or encourages racism, sexism, hatred or bigotry (including for example and without limitation, language that could be deemed discriminatory towards an individual’s race, colour, ethnicity, national origin, religion, disability, or physical appearance);
• encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offense;
• is defamatory or libelous;
• involves the transmission of “junk” mail or “spam”;
• contains any spyware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Radius or otherwise;
• is harmful to minors; or
• impersonates any other person, including falsely stating your name.

We don’t control any of the things our users say or do, so you are solely responsible for your interactions with other users of the App.

3. PRIVACY

For information about how Radius collects, uses, and shares your personal data, please check out our Privacy Policy. By using Radius, you acknowledge that we may use such data in accordance with our Privacy Policy.

4. LICENSE

Unless otherwise stated, Radius and/or its licensors own the intellectual property rights for all material on Radius. All intellectual property rights are reserved. You may access this from Radius for your own personal use subject to restrictions set in these terms and conditions.

You must not:

• Republish material from Radius
• Sell, rent, or sub-license material from Radius
• Reproduce, duplicate, or copy material from Radius
• Redistribute content from Radius

This Agreement shall begin on the date hereof.

Parts of this app allow users to post and exchange opinions and information in certain areas of the App. Radius does not filter, edit, publish, or review Comments prior to their presence on the App. Comments do not reflect the views and opinions of Radius, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, Radius shall not be liable for the Comments or for any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this application.

Radius reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive, or causes a breach of these Terms and Conditions.

You warrant and represent that:

• You are entitled to post the Comments on our App and have all necessary licenses and consents to do so;
• The Comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party;
• The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy
• The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant Radius a non-exclusive license to use, reproduce, edit, and authorize others to use, reproduce and edit any of your Comments in all forms, formats, or media.

5. HYPERLINKING TO OUR APP

The following organizations may link to our App without prior written approval:

• Government agencies;
• Search engines;
• News organizations;
• Online directory distributors may link to our App in the same manner as they hyperlink to the Websites of other listed businesses; and
• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

These organizations may link to our home page, to publications, or other App information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site.

We may consider and approve other link requests from the following types of organizations:

• commonly-known consumer and/or business information sources;
• dot.com community sites;
• associations or other groups representing charities;
• online directory distributors;
• internet portals;
• accounting, law, and consulting firms; and
• educational institutions and trade associations.

We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavorably to ourselves or our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Radius; and (d) the link is in the context of general resource information.

These organizations may link to our App so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our App, you must inform us by sending an e-mail to Radius. Please include your name, your organization name, and contact information as well as the URL of your site, a list of any URLs from which you intend to link to our App, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our App as follows:

• By use of our corporate name; or
• By use of the uniform resource locator being linked to; or
• By use of any other description of our App being linked to that makes sense within the context and format of content on the linking party’s site.

No use of Radius's logo or other artwork will be allowed for linking absent a trademark license agreement.

6. CONTENT LIABILITY

We shall not be held responsible for any content that appears on the application. You agree to protect and defend us against all claims that are rising on our App. No link(s) should appear on any application that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third-party rights.

7. RESERVATION OF RIGHTS

We reserve the right to request that you remove all links or any particular link to our App. You approve of immediately removing all links to our App upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our App, you agree to be bound to and follow these linking terms and conditions.

8. PAYMENT TERMS

Generally, Radius may offer products and services for purchase on the App (“In-App Purchase”). If you choose to make an In-App Purchase, you acknowledge and agree that additional terms, disclosed to you at the point of purchase, may apply, and that such additional terms are incorporated herein by reference.

You may make an In-App Purchase through the following payment methods (“Payment Method”): 

(a) making a purchase through a third-party platform such as the Apple App Store and Google Play Store (“Third Party Store”), or 

(b) paying with your credit card, debit card, or PayPal account, which will be processed by a third-party processor. Once you have made an In-App Purchase, you authorize us to charge your chosen Payment Method. 

If payment is not received by us from your chosen Payment Method, you agree to promptly pay all amounts due upon demand by us.

Canceling Subscriptions. If you purchased a subscription directly from Radius, you may cancel or change your Payment Method via the payment settings option under your profile. If you purchased a subscription through a Third Party Store, such as the Apple App Store or the Google Play Store, you will need to access your account with that Third Party Store and follow instructions to change or cancel your subscription.

We know our Terms are awesome, but we may have to change them now and again

As Radius grows, we might have to make changes to these Terms so we reserve the right to modify, amend or change the Terms at any time. If we do this then the changes will be posted on this page. In certain circumstances, we may send an email to you notifying you of a change. It’s also possible that we might ask you to agree to our changes, but we’ll let you know. You should regularly check this page for notice of any changes – we want our users to be as informed as possible.

Your continued use of Radius following any change constitutes your acceptance of the change and you will be legally bound by the new updated Terms. If you do not accept any changes to the Terms, you should stop using Radius immediately.

9. GOVERNING LAW AND FORUM

Your access to the App, Our Content, and any Member Content, any claims arising from or related to your relationship with Radius, and these Terms are governed and interpreted by the laws of the Kingdom of Saudi Arabia. All claims arising out of or relating to these Terms and/or your relationship with Radius Company that for whatever reason are not submitted to arbitration, and all claims or cases challenging the enforceability or applicability of the arbitration provisions herein, will be litigated exclusively in the federal or state courts of Saudi Arabia. You agree that such courts shall have personal jurisdiction and venue and waive any objection based on inconvenient forum. You agree that you will not file or participate in a class action against us.
